By accessing or using the BeeSwarmly platform, website, hardware, or services (collectively, the “Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms apply to all users, including beekeepers, apiary managers, and any individual or organization accessing the platform.
BeeSwarmly provides hive monitoring hardware (sensors, scales, gateways) and a cloud-based software platform that collects sensor data and generates predictive analytics, including swarm risk assessments, health alerts, and trend analysis. The Service is designed as a decision-support tool and does not replace professional apicultural judgment.
To use the platform, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must notify us immediately of any unauthorized use. You must be at least 16 years old to create an account.
Platform access is provided through monthly subscription tiers. Subscription fees are billed monthly in advance. You may upgrade, downgrade, or cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. Hardware purchases are one-time transactions and are non-refundable after 30 days, except in cases of manufacturing defects covered under warranty.
All BeeSwarmly hardware is covered by a three-year limited warranty against manufacturing defects. The warranty does not cover damage caused by improper installation, environmental exposure beyond IP67 rated conditions, physical impact, or unauthorized modification. Warranty claims should be submitted to app@beeswarmly.com.
You retain ownership of all hive sensor data generated by your hardware. BeeSwarmly retains ownership of the platform software, prediction models, algorithms, user interface designs, and all associated intellectual property. You may not reverse-engineer, decompile, or attempt to extract source code from any BeeSwarmly software or firmware.
You agree not to use the Service to violate any applicable laws or regulations, interfere with the operation of the platform or other users’ access, attempt to gain unauthorized access to any systems or data, resell or redistribute the Service without written authorization, or submit false or misleading information.
BeeSwarmly provides swarm predictions as probabilistic estimates based on sensor data and statistical models. Predictions are not guarantees. BeeSwarmly is not liable for any colony losses, economic damages, or other harm resulting from acted-upon or missed predictions. The Service is provided “as is” without warranties of any kind, express or implied, including fitness for a particular purpose. Our total liability to you shall not exceed the amount you paid for the Service in the twelve months preceding the claim.
We strive to maintain continuous platform availability but do not guarantee uninterrupted service. Scheduled maintenance windows will be communicated in advance. We are not liable for service interruptions caused by internet outages, power failures, natural disasters, or other circumstances beyond our control.
We may suspend or terminate your access to the Service if you violate these terms, fail to pay subscription fees, or engage in conduct that harms other users or our infrastructure. Upon termination, your right to use the platform ceases immediately. You may export your data for 30 days following termination.
We may modify these Terms of Service at any time. Material changes will be communicated via email at least 14 days before taking effect. Continued use of the Service after modifications constitutes acceptance. If you disagree with updated terms, you may cancel your subscription and close your account.
These terms are governed by the laws of the State of California, United States. Any disputes arising from these terms or your use of the Service will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in Sacramento, California.
